Individual Membership Rules

Individual Membership Rules

Chapter 1. Name and Location

Article 1. Name
The Mori Art Museum (hereinafter called the “Museum”) shall mean the museum managed and operated by Mori Building Co., Ltd. (hereinafter called the “Operator”). MAMC, Mori Art Museum Membership Program (hereinafter called “MAMC”) shall mean the membership program for the Museum managed by the Operator under the terms and conditions hereinafter set forth.
Article 2. Location
The Museum is located at Roppongi Hills Mori Tower, 53rd Floor, 10-1, Roppongi 6-chome, Minato-ku, Tokyo, Japan.

Chapter 2. Rules

Article 3. Application of These Rules
The Operator hereby establishes the rules to govern terms and conditions by which an individual member, as defined in Chapter 3 hereof (hereinafter called the “Member”), uses the Museum and the members’ benefits described in Chapter 5 hereof (hereinafter called the “Members’ Benefits”) and other terms and conditions that must be upheld as a Member.
Article 4. Changes to These Rules
The Operator may from time to time make changes to these rules by notifying the Member of such changes in such manner as the Operator deems appropriate. Thereafter, terms and conditions of MAMC, including those of the Members’ Benefits, shall be subject to such changes.
Article 5. Additional Rules
The Operator may from time to time establish rules in addition to these rules and make any changes thereto, which shall constitute an integral part hereof.

Chapter 3. Members

Article 6. Members
As used herein, a Member shall mean an individual eighteen years of age or older who shall have applied for MAMC and shall have been admitted under Article 8 hereof.
Article 7. Types of Members
The types of the Member shall be as follows:
1) “Fellow Member”
A “Fellow Member” shall mean any person who has completed application procedures as described in Article 8 hereof, and paid the annual fee for a Fellow Member as described in Section 1 of Article 8 hereof.
2) “Benefactor Member”
A “Benefactor Member” shall mean any person who has completed application procedures as described in Article 8 hereof, and paid the annual fee for a Benefactor Member as described in Section 1 of Article 8 hereof.
Article 8. Admission
1. Any person who applies for MAMC (hereinafter called the “Applicant”) shall apply in accordance with the operating procedure stipulated on the Mori Art Museum Website (URL: https://www.mori.art.museum; hereinafter called the “Operator’s Website”) and pay by credit card the annual fee as described below (including applicable national consumption tax and local consumption tax (together hereinafter called “consumption tax”)).
Fellow Member 22,000 yen
Benefactor Member 44,000 yen
2. In the event the Applicant is or is deemed to be inappropriate for MAMC in the Operator’s judgment, the Operator may decline to accept the Applicant or may cancel its approval for admission of the Applicant at any time.
3. The application procedures for admission to MAMC shall be deemed completed when the Operator confirms completion by the Applicant of the required application procedures and its receipt of the annual fee hereunder. At such time, the Operator shall approve admission of the Applicant to MAMC for a period of membership commencing on a date calculated based on Article 9 hereof.
4. Upon completion of application procedures, the Operator shall issue the Applicant a Member’s Card under Chapter 4 hereof (hereinafter called the “Member’s Card”). The Operator shall aim to issue the Member’s Card around one week after completion of application procedures.
5. The annual fee may be subject to change at the Operator’s discretion.
6. The annual fee paid to the Operator hereunder will not be refunded to the Member for any reason.
Article 9. Membership Period
The Member’s period of membership in MAMC shall commence from the date on which the procedures for application to MAMC are completed (hereinafter called the “Application Procedures Completion Date”) and continue for one year (or, if the Application Procedures Completion Date falls in the middle of the month, the membership period shall end on the last date of the month which includes the day on which one year elapses since the Application Procedures Completion Date).
Article 10. Changes to Membership Period
1. The membership period shall be renewed automatically for a period of one year commencing from the date immediately following the end of the current membership period (hereinafter called the “the Expiration Date”), and will continue to be renewed in this way annually, if the Member, having received the membership period renewal notice by E-mail, has subsequently not followed procedures for notifying the Operator that he or she will not renew within the period separately stipulated by the Operator (hereinafter called the “Withdrawal Procedure”). In such cases, the Member shall pay the annual fee for the post-renewal membership period as prescribed in Section 1 of Article 8 hereof by the credit card used for the payment in accordance with section 1 Article 8 hereof on the 10th of the month which includes the Expiration Date (or the next bank business day in cases where the 10th falls on a bank holiday). Furthermore, if a Member conducts the Withdrawal Procedure within aforesaid period, said Member shall withdraw from MAMC upon the expiration of the membership period. In addition, if the Operator notifies the Member that the Operator will not renew the membership period by E-mail or other method that the Operator deems appropriate, the member shall withdraw from MAMC on the expiration date upon the expiration of the membership period.
2. The Member may not withdraw from MAMC during the membership period. However, the Member may give notice during the membership period that he or she will not renew the membership. Upon receipt of such notice from the Member, the Operator shall stop E-mailing notifications to the Member pertaining to the Members’ Benefits provided during the membership period or other notifications related to MAMC, if required.
Article 11. Change of Registered Information
If there is any change in the Member’s name, address, telephone number, e-mail address, or any other registered information, the Member shall perform the change according to the procedure designated by the Operator without delay, and the Operator shall not be responsible for any loss, including but not limited to late or undelivered E-mail, postal mail or any other correspondence, incurred by the Member due to his or her failure to perform said change.
Article 12. Suspension and Cancellation of Membership
The Operator may suspend or cancel the Member’s membership without notice to him or her in the event of any of the following. In the case of such suspension or cancellation, the Operator shall not be responsible for any loss or damage incurred by such Member or any third party as a result thereof.
1) Any conduct by the Member in violation of good public order, or applicable laws, rules, or regulations;
2) Any defamation, disturbance, or other similar conduct by the Member against other Members or third parties;
3) Any conduct by the Member which interferes with the operation or management of the Museum;
4) Any false statement or representation made by the Member to the Operator;
5) Any case in which it becomes known that the Member is an organized crime group, a member or an associated member of an organized crime group, a group related to an organized crime group, a person related to an organized crime group, a group that encourages or is likely to encourage a member of any such entity (including any group) to commit any unlawful or unjust behavior, or any other anti-social force (including persons related to any organized crime group provided for in Article 2(4) of the Tokyo Metropolitan Ordinance for Eliminating Organized Crime Groups (Tokyo Metropolitan Ordinance No. 54 of 2011; as amended); each hereinafter called the “Organized Crime Group Etc.”), is controlled by an Organized Crime Group Etc., or has a relationship with an Organized Crime Group Etc.
6) Any default on payment of the annual fee prescribed in Section 1 of Article 10 hereof.
7) Any conduct by the Member prohibited by the provisions of Article 25 hereof:
8) Any violation by the Member of any of the provisions hereof; or
9) Any other event or conduct which is not appropriate as to the Member in the Operator’s judgment
Article 13. Prohibition of Assignment
The Member shall not loan or assign his or her MAMC membership or any right or obligation arising therefrom, whether in whole or in part, to any third party, nor shall pledge or create any lien on the same.
Article 14. Privacy of the Member
1. The Operator will treat the Member’s personal information as defined in Section 1 of Article 2 of Personal Information Protection Act (hereinafter called the “Member’s Personal Information”) in accordance with the privacy policy separately established by the Operator. 2. The Operator may at its discretion change any terms and conditions of the Privacy Policy. In the case that the Operator changes the terms and conditions of the Privacy Policy, the Operator will treat the Member’s Personal Information in accordance with the Privacy Policy as changed.

Chapter 4. Member’s Card, Guest’s Card, Login ID, and Password

Article 15. Issuance of the Member’s Card and the Guest’s Card
Every Member shall receive a Member’s Card and the Guest’s Card(s) from the Operator. Thereupon, the Member shall sign his or her Member’s Card.
Article 16. Presentation of the Member’s Card and the Guest’s Card
1. When the Member receives the Members’ Benefits, the Member shall carry his or her Member’s Card without fail and present it to the Museum’s staff upon request. From the completion of the application procedures until the issuance of the Member’s Card, the Member may follow the prescribed procedures for having his or her identity confirmed at the Mori Art Museum Information Desk (located at Roppongi Hills Mori Tower, 3rd Floor) in lieu of presenting a Member’s Card.
2. When the Guest’s Card holder receives the Members’ Benefits, he or she shall carry his or her Guest’s Card without fail and present it to the Museum’s staff upon request.
Article 17. Reissuance of the Member’s Card and the Guest’s Card
1. In the event of loss of the Member’s Card, a new Member’s Card will be issued in accordance with the Operator’s procedures, on the condition that a reissuance fee of 550 yen (which includes any consumption tax) is paid by the Member.
2. The Operator shall not reissue the Guest’s Card for any reason whatsoever. In the case of loss of the Guest’s Card, the Members’ Benefits to which Section 2 of Article 16 hereof is applicable shall not be received.
Article 18. Loan of the Member’s Card and the Guest’s Card
1. The Member shall not loan or assign his or her Member’s Card to any third party, nor shall he or she pledge or create any lien on the Member’s Card.
2. The Member shall not assign the Guest’s Card to any third party for value, nor shall he or she pledge or create any lien on the Guest’s Card.
In addition, the Member shall not allow the guest card user to rent or transfer the Guest’s Card for a fee, pledge the Guest’s Card or otherwise use the Guest’s Card for the provision of collateral.
Article 19. Unauthorized Use of the Member’s Card and the Guest’s Card
In the case of any unauthorized use of the Member’s Card and the Guest's Card by a third party due to theft or any other reason, the Member shall be solely responsible for such unauthorized use.
Article 20. Return of the Member’s Card and the Guest’s Card
The Member shall return to the Operator his or her Member’s Card and the Guest’s Card or cut through and dispose of it on his or her own responsibility immediately after his or her loss of MAMC membership for any reason hereunder.
Article 21. Login ID and Password
1. A Member shall be responsible for good management of the login ID and password he or she acquires during Admission.
2. A Member may not allow any third party to use his or her login ID and/or password in any way whatsoever, including but not limited to, assignment, loan, name change, or the creation of a lien.
3. The Operator shall not be responsible for compensation for damages or losses due to misuse of the login ID and/or password or use thereof by any third party.

Chapter 5. The Members’ Benefits

Article 22. Provision of the Members’ Benefits
1. The Operator shall provide the Member with free admission to exhibitions at the Museum as well as any Members’ Benefits separately prescribed by the Operator, based on the Member’s membership type
2. The Operator may at its discretion and at any time establish matters to be observed, operational rules, etc. for the Members to use the Members’ Benefits.
Article 23. Change of the Members’ Benefits
The Operator may change any part of the Members’ Benefits after posting notice of said change of the Members’ Benefits on the Operator’s Website with one month’s notice to the Member.
Article 24. Interruption of the Members’ Benefits and Termination of MAMC
1. The Operator may temporarily interrupt any of the Members’ Benefits without notice to the Member in the event of any of the following:
1) Any urgent work required by the Operator for maintenance of the Museum or MAMC;
2) Any loss or damage suffered by the Museum or the Operator due to any reason, whether Force Majeure or not; or
3) Any urgent circumstances similar to any of the above.
2. The Operator may terminate the operation of MAMC at any time with one month’s notice to the Member.
Article 25. Prohibited Conducts
Members may not use the Members’ Benefits for improper purposes (including, but not limited to, transferring or providing benefits included in the Members’ Benefits to unspecified third parties for consideration).
When providing the benefits included in the Members’ Benefits to a third party, the Member shall ensure that the third party does not use the benefit for any improper purpose.

Chapter 6. Miscellaneous

Article 26. Copyright and Other Rights
The Operator shall have the copyright and all other rights in any and all contents contained in the Operator’s Website, member magazines, E-mail newsletters, and any other materials.
Article 27. No Responsibility
In the event that the Member suffers any loss due to the interruption or termination of the Members’ Benefits for any reason attributable to the Operator, the amount of compensation to be paid by the Operator shall in no event exceed the amount of the annual fee payable by such Member for that year; provided, however, that this shall not apply when there is the Operator’s willful misconduct or gross negligence.
Article 28. Damage Claim
The Member shall be liable for any damages suffered by the Operator due to any violation of these rules or any unfair or unlawful conduct of the Member.
Article 29. Notices
Any notice given to the Member by e-mail, telephone, facsimile, or any other method based on the contact information contained in the Member’s application shall be deemed effective upon dispatch thereof.
Article 30. Language
These rules have been prepared in the Japanese language. Any translation into English or any other language shall be for reference purposes and convenience only, and the original Japanese version will govern the interpretation of these rules.
Article 31. Exclusive Jurisdiction
The parties agree that Tokyo District Court shall have exclusive jurisdiction over any dispute between the Member and the Operator.
Article 32. Governing Law
These rules shall be interpreted and governed by the laws of Japan.
Effective Date
1. These rules shall be effective as of November 1, 2008.
2. These rules have been partially-changed on June 1, 2011.
3. These rules have been partially-changed on April 1, 2015.
4. These rules have been partially-changed on March 31, 2020.

Use of Credit Cards

  • * Please be sure to use a credit card with the same name for the cardholder as the name used in registering for membership. Use of cards that belong to members of your family as well as stolen cards is strictly prohibited.
  • * If any trouble resulting from the misuse of credit cards is detected, it will be subject to a thorough investigation by ZEUS Corporation, which carries out online credit card transactions.
